1. Acceptance of Terms

By downloading, installing, or using the Smyle application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Smyle is an AI-powered dental health coaching application that provides:

• Daily dental analysis through smile scanning
• A dental health score (0-100) across six dimensions (Whiteness, Gum Health, Plaque, Staining, Alignment, Overall Cleanliness)
• Personalized dental care recommendations
• Progress tracking and historical comparisons
• Daily dental routine with habit tracking and streak gamification
• Achievement badges for consistent dental care

3. Medical Disclaimer

Smyle is not a medical device and does not provide medical advice. The AI-generated dental health scores, recommendations, and analysis are for informational and educational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of a qualified dentist or healthcare provider with any questions regarding a dental or medical condition. Never disregard professional medical advice or delay seeking it because of information provided by the App.

If you have a dental condition that requires medical attention (including but not limited to severe tooth pain, swollen gums, persistent bleeding, or signs of infection), consult a healthcare professional immediately.

4. Account Registration

To use Smyle, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent or guardian's consent.

5. Subscriptions & Payments

5.1 Subscription Plans

Smyle offers premium features through paid subscription plans. Current plans include weekly and annual options. Prices are displayed in the App and may vary by region.

5.2 Free Trial

We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

5.3 Billing

All payments are processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple ID settings.

5.4 Refunds

Refund requests are subject to Apple's refund policies. We do not directly process refunds for App Store purchases.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload images that do not depict your own teeth or smile
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Share your account with others or create multiple accounts
• Use automated methods to access or interact with the App
• Misrepresent your identity or affiliation
• Use the App to provide medical or dental advice to others

7. Intellectual Property

The App, including its design, features, code, AI models, and content, is owned by Ysamihal and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You retain ownership of your dental photos. By using the App, you grant us a limited license to process your images for the purpose of providing the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Ysamihal and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the AI analysis will be accurate, complete, or error-free.

9. Indemnification

You agree to indemnify and hold harmless Ysamihal from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately.

You may terminate your account at any time through the App's Profile > Delete Account. This will permanently delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Paris, France.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the revised Terms.
